www.GO-Makkah.com website ((hereinafter referred to as "GO-Makkah") is available to all users (hereinafter referred to as "User"). The use of GO-Makkahis subject to the unconditional acceptance of these terms and conditions of use.

GO-Makkah provides Users with the following:

• Web-site content, should it be texts, photos, videos, etc…
• Search engine allowing users to find the packages, hotels or other products and services related to Hajj and Umrah
• Religious assistance in the mode of User’s questions and answers to them
• Online store where User can buy all necessary things for the Hajj and Umrah
• System of online booking of Hajj, Umrah or stay in hotel by payment of the service fees already included in the total price

The User hereby declares that he or she is an adult (at least 18 years old) and has the legal capacity to be bound by this agreement and to use this Website in accordance with these terms and conditions of use, which he or she fully understands and recognizes. The User agrees to keep confidential any passwords provided by GO-Makkah to access the Website and ensure that no unauthorized third parties gain access to them. The User accepts responsibility for any financial consequences arising from the use of this Website with the User's password to GO-Makkah Website or from the use of the User's passwords by third parties. Furthermore, the User declares that all information he or she provides to access this Website and while using it is true, complete and accurate, and he/she agrees to keep it updated.

This Website is solely and exclusively for the User's personal use. The Website may not be modified, reproduced, duplicated, copied, distributed, sold, resold or exploited for commercial or non-commercial purposes.

The User agrees not to use this Website for illegal or prohibited purposes. In particular, the User accepts that he or she will only use this Website for him/herself and that the products or services purchased through this Website will be for his or her own use or consumption, or the use or consumption of persons on behalf of whom he or she is legally authorized to act. The User shall not resell to third parties products or services purchased through this Website.

Purchasing products and services through the Website

GO-Makkah Website provides the User with access to information about the products and services of the third parties related to pilgrimage to Makkah and, in certain cases, he or she can make bookings of these products and services from the corresponding Suppliers.

Bookings of products or services of any Suppliers chosen by the User shall be subject to the specific terms and conditions that the Suppliers establish for each case. The User agrees to accept and comply with the purchase terms and conditions established by any Supplier from which the User chooses to book services, including but not limited to the payment of any amounts due and compliance with any regulations and restrictions related to the availability of proposed rates, products or services. In the event that there are special regulations or restrictions that may affect certain rates, products or services selected by the User, such special regulations or restrictions shall be clearly displayed to the User on the screen before proceeding to the reservation.

The preparation and updating of information on offers, products or services, prices, routes, distances, features and any other data and other relevant information about the products and services offered through the Website is the sole responsibility of the respective Suppliers of the products and services. Moreover, GO-Makkah is not responsible for the maintenance, supervision or updating of said data and information, or for verifying its truthfulness, updating, accuracy or completeness.

Suppliers of products or services, each one within the scope of its own obligations, shall be liable to the User for complying with the obligations arising from the regulations in force and the terms and conditions of sale for each of the products and services purchased. GO-Makkah assumes no responsibility or liability whatsoever for products or services that it does not provide directly.

In accordance with Article L.134-2 ofFrench Consumer Code, the electronic document by which the agreement to purchase products and/or services is formalized shall be filed in the records of GO-Makkah and may be accessed by the User at any time upon the latter's request to GO-Makkah.

The User should take into account all information and recommendations provided by Saudi authorities and local authorities related to pilgrimage to Makkah, namely by browsing the website of Hajj Ministry (http://hajjinformation.com) and other similar sources.

The User should respect all particular procedures related to the application of the Hajj/Umrah visa via the concerned travel agency. The User only is responsible for application for all other required visas in order to perform his/her trip. The User only is responsible for any damage followed by missing of any formality of that nature.

Numerous countries besides Saudi Arabia require the passport to be valid for at least 6 months after the date of return. The User should contact concerned embassy or consular in order to get the right information.

Children and babies should have their passports too. The name written in the passport should correspond to the name in the booking form.

-          Modification, cancellation, retraction

According to the Article L.121-20-4 of the French Consumer Code, the right forretractionis not applicable tothe contractshaving as theobjectof services accommodation, transport, cateringor other animation services which should be providedon the given date or within a given period. The major part of services provided by the Suppliers of GO-Makkah belongs to the named above service categories. Thus,the Usercan’t benefit from the right for retractionin terms of bookings occurred on the Website.

Religious assistance

Religious assistance provided by GO-Makkah is presented in the form of questions / answers. Questions are submitted by the Usersand the answers are provided byDrBrahamiwho is an editor of“Hajj andUmrah” guide book.

Once the Usersubmits his / her question on the Website, GO-Makkah team validates it before transferring it to DrBrahami.

Questions which are not related to Islam or pilgrimage to Makkahare not considered. GO-Makkah has right to refuse ordeleteat any moment and without any prior notice all questions or commentswhich are considered bothersome by GO-Makkah team.

Online store

The products to be purchased displayed in the GO-Makkah online store. These products are available stock. Photos of the products are as accurate as possible, but can’t ensure a perfect similarity with the product, especially regarding the colors.

-          Pricing

All prices displayed in the online store include all taxes and VAT applicable in the day of purchase. All changes of  VAT can change the final prices of products and services.

AMIR MEDIA has right to modify prices at any moment. Nevertheless, the price displayed in the day of purchase is the only price applicable to the buyer.

Prices don’t include cost of delivery and occasional service fees.

Any cost and expenses associated with the customs clearance procedure, customs brokerage, damages’ and storage charges, outland & inland freight and any other cost or expenses will be paid in full by the User in destination country.

-          Orders

The User willing to buy the products and services should:

• Fill in the registration form;

• Fill in the order form;

• Validateorder;

• Perform payment with respect of all sales conditions;

• Confirm purchase and payment.

Confirmation of purchase means acceptation of the present General Sales Terms and Conditions, as well as other particular conditions displayed for each purchase.

All data and purchase confirmation mean approved transaction. Order confirmation means signature and acceptance of all occurred transactions. GO-Makkah will send en electronic confirmation of registered order.

-           Delivery

Delivery is made to the postal address recorded during the order processing. All risks are on the side of buyer once the ordered items get sent. In case of any damage during transportation, the complaint must be made with the carrier within three days after delivery.

Delivery terms are purely given as an indication. They will start at such date that we possess complete information, especially that of a delivery date. Readiness or shipment notice date is the only one recognized as valid. Late shipments can no way be construed to obtain either penalty or compensation allowance.

If ordered items haven’t been delivered within 30 days after the purchase was validated, such order can be cancelled and the User can be refunded.

-           Discounts for whole-buyers

There’s a discount of 5% for all orders of more than 10 items of the same product by the same person or company.

-          Heavy items

If the order contains one or more heavy items, GO-Makkah will ask independently from the total cost of order some additional fees for transportation. Postal boxes don’t accept large or heavy items. Thus, such items are delivered directly at the User’s home.

-          Retraction

GO-Makkah replaces the items if they don’t suite to the User in case if they are sent back to GO-Makkah within 7 daysafter the delivery to the User was made, they are new and in their original package.

If the item is damaged or already used, it will not be accepted or replaced. All possible charges related to that item will be in the User’s responsibility.

In case of replacement the delivery to seller will be on the seller’s charge only if the seller confirmed by a written notice that replacement or return of the article in question is accepted. Invoice should follow such article. Only normal postal sending is accepted.

New delivery will be paid by the seller. In case of return, customer will be refunded.

If return is not possible by postal sending (for example: heavy item), the User should send a written request for the item return within mentioned delay to the following address: AMIR MEDIA, 27 rue des alouettes 94470 Boissy-St-Leger. The seller will take in charge return of such item.

-          Payment modes

In order to simplify your purchase, we offer you the possibility to settle your order through credit cards having the logo CB (Visa etMastercard), or by using PAYPAL services.

-          Securedpayment

We use the SSL protocol (Secure Socket Layer) as the safest way to secure your payment for goods and services sold. GO-Makkah has selected payment security by internet with Ogone. Based on the buyer’s possibilities, payment security is based on the following protocols: SSL for those buyers using Netscape Navigator or Microsoft Internet Explorer. SSL protocol uses public and private keys cryptographic technologies, and its certification is developed by RSA Data Security Inc.

This protocol controls both keys and server certification before any exchange of information. Every message is sent on the retailer server according to ISO 8583 norm. The data is protected at the time the order is transmitted.

We will also accept payments by bank checks made to the order of GO-Makkah. However, your order will only be processed after receipt of your check.

Policy on privacy and protecting personal data

GO-Makkah respects the User's privacy and protects his or her personal data.
In order to access the services that GO-Makkah offers through this Website, the User must provide the personal data indicated on the online booking form (hereinafter referred to as "Booking Form").

In compliance with the French Law of 6^th January 1978 on the Protection of Personal Data, GO-Makkah hereby informs the User that by completing the Booking Form, the User's personal data will be incorporated and processed in the files owned by GO-Makkah for the purposes of providing and offering its services and to carry out the corresponding procedures (management of reservations and of the products and services purchased), sending information and advertising on offers, promotions and any recommendations from GO-Makkah, as well as for surveys, statistics and market trend analyses. In order to personalize these services and adapt them to the User's needs and interests, thereby allowing GO-Makkah to send the User the best offers on the market, Users are asked to update this information regularly by notifying us of any change that occurs in the data provided.

Furthermore, GO-Makkah informs the User of their right to access, correct, cancel and challenge his or her personal data. In compliance with the provisions of the French Law of 6^th January 1978 on the Protection of Personal Data, and considering the nature of the products and services that can be accessed through the GO-Makkah Website both nationally and internationally, the User agrees to allow his or her information to be given to any of the partnersofGO-Makkah for the purposes of providing and offering their services and to carry out the corresponding procedures (management of reservations and of the products and services booked), sending information and advertising on offers, promotions and any recommendations from GO-Makkah, as well as for surveys, statistics and market trend analyses.

In the event that products and/or services offered on the GO-Makkah Website are used, GO-Makkah must give the User's personal data to the Suppliers of these products and/or services (tour operators, airlines, hotels, etc.), who in turn must use the User's personal data solely and exclusively to fulfill the purpose of the agreement.

Finally, and for the purposes of the provisions of the Article 69 of theFrench Law of 6^th January 1978 on the Protection of Personal Data, the User agrees to allow GO-Makkah to transfer his or her personal data to recipients, in accordance with the aforementioned terms and conditions, in any country in the world, even those which do not offer the same level of protection as the French Low.

In any event, GO-Makkah guarantees the confidential processing of the User's personal data as well as the server on which it is stored. Said data shall be subject to the safety measures required to avoid unauthorized access by the third parties.

In addition, the User is hereby informed of the following:
•GO-Makkah collects information on the Users' tastes and preferences using the data directly provided by the User and the analysis of data traffic, including the use of cookies (see below). Similarly, it collects information relative to year of birth, sex, nationality, language, children and marital status.
• When the User purchases a product or service through the GO-Makkah Website, he or she must specify his or her name, email address, credit or debit card number, its expiry date and telephone number. GO-Makkah may have to inform its messaging service of the User's telephone number in order to process his or her order and to provide information on its status.
• If the User participates in a contest or promotion, GO-Makkah will request his or her name, postal address and email address to organize the contest or promotion in question and to notify the winner(s).

Nevertheless, it is possible that GO-Makkah may provide this information to the third parties with whom GO-Makkah has commercial relations, which may reside anywhere in the world, in the event that the User reserves or purchases a product or service through its Website. GO-Makkah may also provide global statistics on sales, customers, data traffic and other information from the Website to these third parties. However, such statistics shall not include any data that may make it possible to personally identify the User.

Limitation of Liability

GO-Makkah offers this Website as-is and does its best in respect of its updating, maintenance and functioning, but it makes no guarantees as regards technical faults, service infallibility, or that the system or portal will function at all times.

GO-Makkah publishes on its Website various information about the products and services provided and offered by the third parties, and it can make no representations about the truthfulness, accuracy, completeness and updating of the data contained in such offers.

In any case, GO-Makkah assumes no liability for any damages arising directly or indirectly from the booking of a product or service offered on its Website due to negligence on the part of the Supplier of said product or service, or some other cause not attributable to GO-Makkah.

If due to reasons of force majeure (including, but not limited to, political, economic or unstable disorder that affects safety), there are deficiencies with reservations, confirmations and/or execution of any trips or services booked through GO-Makkah due to unexpected circumstances that GO-Makkah cannot solve, or even if it were impossible to comply with any of the agreed provisions, GO-Makkah and/or Suppliers are exempt from any derived legal responsibilities arising from such deficiencies or non-compliance.

Law and applicable jurisdiction

These General Terms and Conditions, as well as any relation between GO-Makkah and the User, shall be governed by the laws of France. Both parties are subject to the jurisdiction of the Courts of the city of Creteil for any litigious issue arising from the existence, content and/or interpretation of these General Terms and Conditions or from any relation between GO-Makkah and the User.
